Construction Risks Identification and Dispute Resolution

Thunder BayThe City of Thunder Bay engaged DCSC to review an in progress CAD 55M construction programme to identify potential risks to on-time and within-budget completion. DCSC identified schedule deficiencies and an absence of schedule maintenance, look-ahead schedules, and specialty trade co-ordination as the principal risk to completion and budget. DCSC recommended several changes to the approach to managing the project, scheduling procedures and monitoring, and that the City retain a scheduling consultant to prepare and manage construction schedules for the remainder of the project. The City acted upon all recommendations and the project was completed within acceptable timelines and without further additional costs. DCSC also reviewed one disputed Trade Contract and prepared three reports with recommendations regarding appropriate resolution. The City acted upon the report recommendations and resolved the claim through negotiation.

Sioux Lookout, ONThis $140M hospital opened in October 2010 and almost immediately experienced severe moisture and ice buildup within exterior walls, around all windows within the roof assembly, and at cantilevered roof lookouts. DCSC conducted forensic reviews of construction documents, as-built conditions, and Contractor progress records and prepared reports for use by the Contractor’s legal counsel and building sciences consultant.

Dart Corporation (Decco Ltd) Construction

DCSC was retained by Dart Corporation construction management division, Decco Ltd, to prepare a detailed policies and procedures manual to guide remaining work for its Camana Bay Project which was in progress, and for new construction and project management projects. The 300 page detailed manual written by Reg Nalezyty. Sections included sections for conduct of Construction Estimating, Procurement, Project Management, Project Planning & Integration, Construction Method Statements, Project Schedules, Project Cost Control, Project Documentation and Communication, Contract Changes, Trade Contracts and Change Orders, Jobsite Materials and Equipment Management functions. The manual is now in use by Decco Ltd.
Construction Claim Preparation and Negotiation

DCSC was retained after managing construction of the Project, to assemble and prepare all support documentation and opinion for a $6M construction claim arising from unresolved issues during the course of construction. Reg Nalezyty developed the claim organisation and prepared written arguments for each claim item with supporting documentation, liaised with US/Cayman legal counsel and prepared further documentation as requested. The claim, which required 10 months to prepare, and was successfully resolved in the Contractor’s favour for the full amounts claimed, on all claim items, after a 3 hour negotiation.

DCSC Limited was project and construction manager for this work. Reg Nalezyty was resident in Barbados through the project and led the 6-person site management team. The work consisted of a 98,000SF four storey embassy building and three single storey access control perimeter buildings located on a two hectare walled compound. This complex project included major security installations and was constructed subject to stringent USG security oversight and restrictive regulations governing procurement, labour, and construction methods. The project was occupied in December 2006. Construction cost was USD 40M. This was a finance/build/lease project constructed by a Barbados developer.
DCSC designed the management structure and the construction programme, documentation and safety procedures, sourced suppliers and trade contractors, prepared all requests for quotations, purchase orders and contracts, procured materials, monitored schedules, managed the local workforce, enforced quality control protocols, and in the absence of USG and Design Consultant response and co-operation was required to make numerous Building Code interpretations in order to expedite the Work, and undertook significant redesign work to correct IBC deficiencies in the construction documents. Many of the redesign items formed a significant part of a subsequent $6.1M construction claim which was resolved in favour of the Contractor. DCSC Limited also monitored commissioning team confirmation of all construction, installations, and operating systems.
The US State Department property manager in charge of the completed building, noted after an inspection tour that State Department did not have another facility of comparable quality in the portfolio of buildings for which he was responsible.
Prime Design Consultant

This contract for this $31M project was awarded on the basis of a province-wide call for design proposals. The building was begun in joint-venture with Arthur Erickson Architects (Toronto office). Partner Consultants were Halsall Engineers (structural) and MCW Consultants (mechanical /electrical). AEA left the project due to financial insolvency at the commencement of construction document preparation. All remaining design and all contract administration work was done by DCSC Limited predecessor firm, Reginald Nalezyty Architect Limited. The four storey structure included 22,500 SM of office and support space, and two levels of below-grade parking. The building is a high-profile statement of government presence and makes extensive interior and exterior use of local granite. The building included a day care, fitness centre, restaurant, conference facilities, and savings bank.
Reg Nalezyty selected all exterior cladding components and finishes, and was responsible for detailed design of roof and air barrier assemblies as well as exterior granite and composite metal cladding. To meet completion deadlines, budget limitations, and quality requirements, Reg Nalezyty, designed a delivery system involving four concurrent construction contracts and initiated a detailed and independently administered value engineering exercise as an integral part of the design process. The building was completed ahead of the baseline schedule
timeline for a final sum which was significantly under the pre-tender budge, had few changes to bid documents, and without a single construction dispute.
This building was recognised for its design and construction excellence in 2009 when it was named BOMA Canadian National Award Winner as best building in the country in the Government-owned category.

This early project consisted of design and construction of a 3,300 SM, 2,200 seat, single storey, multi-screen cinema building located on a central downtown site, and with extremely tight schedule and budget constraints. To accelerate construction and meet budget requirements, the building was designed and constructed using loadbearing precast concrete. Design began in mid January, 1981; construction began in early March, 1981, and the project received its occupancy permit and opened on 22 August, 1981. Construction cost was well within the design stage budget. There were no deficiencies at completion of construction and there have been no operations or maintenance issues in the 30 years since this project first opened. Reg Nalezyty was principal architectural designer and structural engineer for this project and subsequently its Project and Construction Manager.
